1. Acceptance of Terms

By accessing or using LuxFoto ("the Service"), operated by LuxFoto ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

LuxFoto is an AI-powered photo enhancement service designed for real estate listings, profile photos, and similar use cases. You upload photos, and our AI processes them to produce enhanced versions.

3. User Accounts

You may use the Service anonymously with limited enhancements. Creating an account (via Google sign-in) provides additional free enhancements and access to paid plans. You are responsible for maintaining the security of your account.

4. Photo License & Ownership

Your photos remain yours. We do not claim ownership of any photos you upload or any enhanced images we generate for you.

By uploading a photo, you grant LuxFoto a limited, non-exclusive, worldwide license to process, modify, and enhance your photo solely for the purpose of providing the Service. This license terminates when your photos are deleted from our systems.

You represent that you have the right to upload any photos you submit and that your photos do not infringe on any third party's rights.

5. AI Processing & Third Parties

Your photos are processed using our proprietary AI enhancement technology. By using the Service, you acknowledge that your photos may be transmitted to secure cloud infrastructure for processing. We select providers with appropriate data handling practices and ensure your photos are processed in compliance with applicable data protection standards.

6. AI Enhancement Accuracy & Output

LuxFoto's AI enhancement technology is designed to preserve approximately 90% or more of the original image content, including composition, layout, objects, and spatial arrangement. However, as with any AI-powered image processing, enhanced photos may contain minor modifications, artifacts, or visual differences compared to the original.

These modifications may include, but are not limited to: subtle changes to textures, colors, lighting conditions, minor object details, or background elements. Such variations are inherent to AI-based image enhancement and do not constitute a defect in the Service.

You are solely responsible for reviewing enhanced photos before use and ensuring they accurately represent the subject matter for your intended purpose, including but not limited to real estate listings, professional profiles, or marketing materials. LuxFoto does not guarantee pixel-perfect fidelity to the original image.

7. Photo Storage & Deletion

Enhanced photos are stored temporarily to allow you to download them. We automatically delete processed photos after 24 hours. You may request deletion of your data at any time by contacting us.

8. Acceptable Use

You agree not to upload photos that:

• Contain illegal content
• Depict child sexual abuse material (CSAM)
• Violate any person's privacy or rights
• Contain malware or malicious code
• Are used for fraudulent or deceptive purposes

We reserve the right to remove content and terminate accounts that violate these terms.

9. Plans & Payments

LuxFoto offers free and paid plans. Paid subscriptions are billed monthly via Stripe. You may cancel at any time through your account settings. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial months.

10. Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee specific enhancement results, uninterrupted service, or that the Service will meet your requirements.

11. Limitation of Liability

To the maximum extent permitted by law, LuxFoto shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service.

12. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
